REGULATORY REVISION DECREE 82/2010 ON SELF PROTECTION PLANS

The Decree 82/2010, of 29 June, approves the catalog of activities and centers obliged to adopt self-protection measures and sets the content thereof. After being in force for a few years and without much success, the Department of Civil Protection has carried out a study in which the following conclusions are reached, which should facilitate and improve the application of the aforementioned regulations :

-Need to make further progress in the implementation of PAUs as security tools (still lacking), and not as a pure administrative procedure.

-Adaptation of the Decree on the basis of the experience gained (updates to be able to move forward better).

-Effort on the part of the activity owners (plans presented and use of HERMES).

-Effort on the part of the administrations (reports and management of PAUs).

-Quality of PAUs in recent months (difference approved/not approved).

-PACE as a practical tool for effective security (application cases)

-There have been difficulties in using the HERMES application.

-Need to make the IT application that makes HERMES work more flexible.

- Good tool for the management, knowledge and maintenance of PAUs.

 

It follows from this study that one must be carried out revision of Decree 82/2010 with the following objectives:

- Incorporate experience since the publication of Decree 82/2010.

– Improve and simplify the wording of the decree and its procedures.

– Clarification of certain aspects of the article.

– Adjust annex I to the level of risk (Catalonia, local) based on experience. Clarifying criteria and simplifying the list of criteria.

– Adjust annex iii to PAU objectives

 

From Engind we are constantly monitoring this review in order to find out which modifications will be approved and thus be able to offer a more complete service in the drafting of Self-Protection Plans.

We can tell you that one of the points that this review modifies will be the deadlines for the presentation of the PAUs by the companies, most of which were sold out, there will be new deadlines to be able to present the PAUs, and if they are not respected there would be some possible penalty.
